Work should feel clear.

These terms describe the operating baseline for Port Orange Media LLC. A signed project agreement or checkout record may add terms for a specific engagement.

Contracting entity and acceptance

These terms apply to the website and services provided by Port Orange Media LLC, a Florida single-member LLC, operating from Florida, United States. By using the site, creating an account, submitting a quote, accepting a proposal, or completing checkout, you confirm that you are legally able to do so and have authority to bind any organization you represent. A proposal, statement of work, project agreement, or checkout record may add terms for a specific engagement. If documents conflict, the signed project agreement controls, then the accepted proposal or checkout record, then these terms.

Services and scope

Port Orange Media provides web, creative, marketing, social-management, and defensive cybersecurity-hardening services. Public package descriptions are starting points, not a promise of an unapproved deliverable. The applicable project agreement controls scope, deliverables, milestones, production window, revision rounds, client dependencies, acceptance criteria, and change requests. Work may pause when required information, approvals, access, or payment is missing.

Client materials and responsibilities

You are responsible for the accuracy, legality, accessibility, and rights to materials, instructions, brand assets, data, and systems you provide. You must respond to approvals and maintain your own backups and access to third-party accounts. You must not provide passwords, API keys, private keys, credentials, exploit details, malware, or information you are not authorized to disclose.

Cybersecurity assessment boundaries

A cybersecurity service is a defensive, authorized review of configuration, exposure, risk prioritization, and remediation options. You must own or have written authorization for every system, account, domain, cloud environment, and network in scope. The written scope and rules of engagement must identify targets, timing, emergency contacts, permitted methods, stop-work authority, and reporting expectations. Port Orange Media will not perform unauthorized access, credential testing, persistence, malware deployment, evasion, denial-of-service activity, third-party port scanning, or other offensive activity. A hardening review is not a guarantee that every vulnerability will be found or that an environment will become risk-free.

Pricing, taxes, and payment

Prices are displayed in U.S. dollars unless a service agreement states otherwise. One-time services are charged through the selected checkout or invoice flow. Subscriptions renew at the stated interval until canceled. Applicable taxes may be calculated by the payment provider when enabled. Payment credentials are handled by Stripe or another expressly identified provider; Port Orange Media does not store raw card numbers or CVC values. We may pause work or access when an amount is overdue, disputed, or dependent on missing client input.

Subscriptions and cancellation

Subscription cancellation normally prevents the next renewal while the current paid period remains active, unless the applicable agreement states otherwise. Cancellation, refunds, prorations, service credits, and work already performed are governed by the applicable agreement and the Refund and cancellation policy. Provider billing records and webhook events control payment status; administrative fulfillment updates do not change payment status.

Refunds and payment disputes

Refund requests must follow the Refund and cancellation policy and may be evaluated against work completed, delivery status, the applicable agreement, and law. If you believe a charge is incorrect, contact hello@portorange.me with the relevant invoice or order reference before initiating a payment dispute where practicable.

Ownership and licenses

You retain ownership of client materials you supply. After required payment, you receive the rights to final deliverables stated in the applicable agreement. Unless expressly assigned, Port Orange Media retains its pre-existing tools, templates, reusable systems, code, methods, know-how, and materials created for general use. Portfolio or public case-study use requires separate approval where appropriate.

Confidentiality and third parties

Each party will use reasonable care with non-public information received for the engagement and will disclose it only to personnel or providers who need it, as required by law, or with permission. The service may depend on hosting, email, payment, identity, analytics, domain, and other third-party providers. Their terms, availability, and processing practices also apply to the relevant service.

Acceptable use and abuse reporting

You may not use the site or services for unlawful activity, fraud, harassment, infringement, spam, unsolicited messaging, purchased or rented contact lists, malicious code, unauthorized access, or activity that harms people, providers, or shared infrastructure. Report suspected abuse or unauthorized use at the abuse-reporting contact on the site. We may investigate, restrict, suspend, or terminate access when reasonably necessary to protect the service or comply with law or provider requirements.

Accounts and security

You are responsible for keeping account credentials and recovery methods secure and for notifying us of suspected unauthorized access. We may require email verification, reauthentication, or other security checks before sensitive actions. Account deletion, retention exceptions, financial records, security logs, and legal obligations may prevent immediate or complete erasure of every record.

Disclaimers

The site and services are provided with reasonable care and skill, but no digital service can guarantee uninterrupted availability, a particular business result, complete security, compatibility with every system, or error-free operation. Provider outages, client delays, third-party changes, and events outside reasonable control may affect delivery. Specific warranties, service levels, exclusions, liability limits, indemnity obligations, and mandatory-law exceptions must be finalized in the applicable agreement and reviewed by counsel.

Governing law and disputes

Unless a written project agreement states otherwise, these terms use Florida law and propose Volusia County, Florida as the venue for disputes, subject to applicable mandatory law and counsel’s final review. Nothing in these terms removes rights that cannot lawfully be waived.

Changes and notices

We may update these terms when the service, providers, or law changes. The current version is 2026-09-12, last updated September 12, 2026. If any provision is unenforceable, the remaining provisions continue to the extent allowed by law.
